Years of Lawyers and Council Time

 

  • A number of years ago, the Village launched a legal action against residents holding legal title to land between the walking path and a portion of the lake bed, along the entire northern border of the Village.
  • The Village was seeking this action in order to have this private land redesignated as Crown land.

Unclear Motives; REjection by court

 

  • The reasons for the Village pursuing such an action are at best vague and unclear, as is who in the Village would benefit from such an action being successful.
  • What is clear is that in May, 2024, the Court of King's Bench ruled that the Village had no standing or right to bring such an action against the residents.

lack of accountability

 

  • In an election yr, the Village has indicated that it will not hold an annual mtg, so no opportunity to understand the amount of our tax dollars that the Village has spent on this action.
  • Based on amts spent by the residents in defending themselves, it is estimated that the Village has spent over $200,000 on this action

High resident costs, for what?

 

  • This equates to almost $500 per household in the Village.
  • As a result of the Court's ruling, on top of this amount, the Village must reimburse the shoreline residents for a portion of their legal fees.
  • More concerning, the Village appears to want to spend even more money pursuing an appeal!

3.  What does this action allow the Village to do which it cannot accomplish through bylaws etc.

4.  How do I know that the Village won't try to take my land next.  Maybe you have a strip of land on your property that others covet, so that gets expropriated too?
